One, Case Summary

Lady Li and Mr. Chen jointly established a warm family after marriage, and the birth of their children added even more warmth to their lives. In order to provide meticulous care for their children and to strengthen the family's support, Ms. Lin resolutely chose to become a full-time housewife, devoting all her efforts to family life, while Mr. Chen focused on his career. However, as the years of marriage went by, their feelings gradually showed cracks, and conflicts accumulated continuously, eventually reaching a point of no return. They have been unable to reach an agreement on the matter of divorce.

Ms. Lin, as a full-time woman who has been away from the workplace for a long time, istrapon/at multiple dilemmas in this divorce dispute: she is deeply worried about not being able to secure custody of her children, and is constantly anxious about the lack of a stable economic source and housing security after the divorce. In addition, the validity of the property agreement signed between the two parties during the marriage is controversial, and the issue of dividing the property purchased by the male party before marriage has become the core focus of the dispute. In order to fully protect her and her children's legitimate rights and interests, Ms. Lin sought out the Guangdong Daohua Law Firm by reputation, decisively entrusted the Tang Yunhong lawyer team to handle the case in full, and clearly proposed the core demands of dissolving the marital relationship, obtaining custody of the children, requiring the male party to pay reasonable child support, and dividing the property.

Section 3: The process of the lawyer handling the case

(1) Rapidly activate the program, seize the initiative in rights protection

After accepting the commission, the Tang Yunhong legal team precisely captured the urgent needs and concerns of Ms. Lin, a full-time mother seeking rights protection, and immediately intervened in the case. They meticulously verified the key time points during the marriage, the composition of the family's property, the details of the children's growth, and the background of the marriage property agreement. In conjunction with Ms. Lin's core demands, the Daohua Marriage and Family Law Firm team quickly identified three core conflicts: the validity of the marriage property agreement, the division of pre-marital purchased property, and the custody and survival guarantee for the full-time mother.

In response to these contradictions, the team formulated a phased "tough battle" strategy of "stabilize the procedures first, break the property next, and finally solidify the rights and interests": the first phase is to quickly advance the filing and seize the initiative in mediation; the second phase is to focus on breaking through the two core disputes of the validity of marital property agreements and the division of real estate; the third phase is to refine subsidiary rights and interests such as child support and visitation rights, ensuring that the agreement is fully enforceable.

To avoid the case from falling into a lengthy litigation process and exacerbating the mental exhaustion of the parties involved, the Daohua Family Law Firm quickly initiated an efficient rights protection mechanism, meticulously sorting out case materials and securing key evidence, and successfully completed the filing procedures within a short period of time. At the same time, the team actively engaged in multi-round communications with the court, the opposing party, and the agent lawyers, fully promoting the case into the mediation process.

(2) Implement targeted policies to revitalize marital property agreements

In response to the controversy over the validity of the property agreement within the marriage between the two parties, the Tang Yunhong legal team did not limit itself to the literal terms of the agreement but formulated flexible strategies by combining the actual circumstances of the case with relevant legal provisions. The Dao Hua marriage and family law team first conducted an in-depth analysis of the background of the agreement signing, the true intentions of both parties, and the actual performance, skillfully resolved the controversy over the validity of the agreement, converting the originally flawed property agreement into a valid basis supporting the female party's claims, and laying a solid foundation for subsequent property division and real estate acquisition.

(Focus on core demands, break through survival dilemmas)

Real estate rights protection: Regarding the property purchased by the male party before marriage, the Daohua Marriage and Family Law Team, starting from LinMs.'s dedication as a full-time housewife and her post-divorce survival security needs, combined with the relevant agreements in the property agreement after revitalization, engaged in multiple rounds of negotiations with the other party. Lawyer Tang Yunhong emphasized LinMs.'s selfless contribution to the family, as well as the realistic difficulties of lacking economic income and needing a transition period to re-enter the workplace after the divorce. Ultimately, the other party agreed to transfer the property to LinMs., with only a reasonable compensation payment for the property required from LinMs., thus solving LinMs.'s post-divorce housing issue and economic concerns.

2. Child Custody and Alimony Pursuit: Considering that Ms. Lin has been the main caregiver accompanying her children's growth for a long time, familiar with their living habits and educational needs, the Tang Yunhong legal team focuses on presenting Ms. Lin's custody advantages based on the principle of "what is most beneficial to the minor children," while also considering the economic burden capacity of the male party, proposing a reasonable alimony claim. By providing evidence of the male party's income status and the actual living, educational, and medical needs of the children, they successfully secured monthly alimony of 10,000 yuan for each child, with the payment period extended to the children's graduation from undergraduate studies, and at the same time, clearly defining the sharing methods for large medical and educational expenses, providing comprehensive protection for the children's growth needs.

(4) Detailed negotiations, finalize a comprehensive mediation plan

During the mediation process, the Tang Yunhong legal team always adhered to the principles of fairness and reasonableness, taking into account the interests and demands of both parties, and communicated and negotiated on each dispute point one by one. In addition to the core issues of marriage dissolution, child custody, and property division, the Dao Hua marriage and family law team also clearly stipulated details such as the payment deadline for property compensation, the payment method for child support, the exercise rules for visitation rights, and the assumption of debts, ensuring that the content of the mediation agreement is comprehensive, specific, and enforceable, and avoiding the emergence of new disputes in the future. At the same time, the team actively coordinated the parties to reach a consensus on the time, method, and pick-up arrangements for the exercise of visitation rights, ensuring that the children can still receive care from both parents after the divorce.

Four, mediation results

Through the professional promotion of the Tang Yunhong Law Firm team and the persistent communication of all parties, both sides have voluntarily reached a mediation agreement. The court has legally confirmed the validity of the agreement, and the mediation result is as follows:

Plaintiff Ms. Lin and defendant Mr. Chen voluntarily dissolve the marriage relationship.

2. The plaintiff, Miss Lin, directly cares for both the legitimate daughter and son. Since the second month after the divorce, the defendant, Mr. Chen, shall pay child support of 10,000 yuan for each child before the 10th of each month until the children graduate from their undergraduate studies; ...

3. The real estate purchased before marriage by the defendant, Mr. Chen, and registered in the name of the plaintiff, Ms. Lin, shall belong to the plaintiff, Ms. Lin; ……

Chapter 5: Insights on Tang Law

Full-time women often find themselves in a relatively vulnerable position in divorce disputes, facing multiple pressures such as child custody, financial support, and housing security. The handling of such cases requires a balance between legal provisions and the actual difficulties of the parties involved, achieving a balance between "legal principles" and "emotional principles"; the Daohua Family Law and Matrimonial Law Team always takes the maximization of the parties' rights and interests as the core goal when handling such cases, formulating personalized and precise strategies based on the specific circumstances of the case. The key points of their core rights protection mainly include two aspects: first, quickly activating the procedures, as the delay in divorce disputes often exacerbates the mental and life pressures of the parties involved, especially for full-time women. Determining the divorce outcome as soon as possible, and clarifying property and custody arrangements, is the key to alleviating survival anxiety. The Tang Yunhong Law Team promotes the filing and mediation procedures efficiently, significantly shortening the case handling cycle, and providing more buffer time for the parties; second, flexibly applying the marital property agreement. The effectiveness of the marital property agreement needs to be determined in combination with various factors. In practice, even if the agreement has certain defects, its effectiveness can be revitalized through the addition of evidence and clarification of the true intentions of both parties, providing a basis for property division. At the same time, the Daohua Family Law and Matrimonial Law Team reminds that when parties sign a marital property agreement, they should pay attention to its standardization. If disputes have arisen, they should seek professional legal assistance in a timely manner to avoid their rights and interests being damaged.
