Shenzhen Divorce Lawyer: Risks of Not Transferring House Ownership in Divorce Agreement

  Many couples, when agreeing to divorce, explicitly state the property division plan in the written agreement, believing that once both parties sign and confirm, the house ownership is settled, and therefore delay the transfer procedures. However, they are unaware that the divorce agreement only has internal constraints between the couple and cannot counteract the external effectiveness of real estate registration. Delaying the transfer may seem to save procedures and fees, but it actually hides multiple legal risks, which can easily result in the loss of the house ownership rights that should have been obtained.
  In our country, real estate follows the principle of registration for effectiveness, and the ownership of the house is determined by the real estate registration information. The divorce agreement cannot directly produce the effect of the transfer of property rights. Even if the agreement content is legally valid, it is only a private property agreement between the two parties. As long as the property is still registered in the name of the other party or both parties, the property rights at the legal level have not been transferred, and the party designated in the agreement cannot obtain complete ownership of the house.

Creditors do not need to know about the divorce property agreement between the couple and can legally enforce the property. Even if the party actually enjoying the property rights raises an objection to the enforcement, it is difficult to obtain court support due to the lack of property ownership registration certificates.
  As time goes by, various disputes may arise, such as when the house price rises, some parties may maliciously regret the agreement, refusing to cooperate with the transfer on the grounds that there are defects in the agreement. Over time, evidence may be missing, leading to protracted litigation. In addition, the property that has not been transferred will directly affect the children's household registration, enrollment, and daily affairs such as water and electricity renaming and subsequent resale, bringing many inconveniences to life.
  The divorce agreement is only an internal agreement between the couple and cannot counteract good faith third parties and judicial enforcement. To truly protect one's rights, one should not have aFortunate attitude. After divorce, one should promptly go to the real estate transfer registration office with divorce certificates, divorce agreements, and other materials to solidify the ownership of the property legally. Timely completion of the transfer is the most secure choice to clarify property relations and avoid risks.
