Shenzhen Divorce Lawyer: Is the Divorce Mediation Document Issued by the Court as Effective as the Divorce Certificate?

  Many parties who have divorced through mediation by the court are puzzled. They only have the divorce mediation document issued by the court, but no divorce certificate issued by the civil affairs department. They wonder if this counts as a formal dissolution of marriage, and whether it will hinder the handling of subsequent matters such as remarriage, household registration transfer, and property transfer. In fact, an effective divorce mediation document has the same legal effect as a divorce certificate, both being recognized as legal proof of the dissolution of a marriage relationship and can be used normally.
  Voluntary divorce and mediation divorce are two statutory methods of divorce. The former involves the couple reaching an agreement voluntarily, registering for divorce at the civil affairs department, and then obtaining the divorce certificate, which is an administrative divorce. The latter is through the litigation channel, where the couple reaches an agreement on divorce under the judge's guidance, and the court prepares and seals the mediation document, which is a judicial divorce. The Civil Code clearly stipulates that upon completion of the divorce registration, or upon the effectiveness of the divorce judgment or mediation document, the marriage relationship is declared dissolved. It can be seen that once the divorce mediation document becomes effective, the couple's marital relationship is completely terminated, and its legal effect is no different from that of the divorce certificate.
  Both have the same legal effect, but there are certain differences in function. The divorce certificate is a simple administrative document, used only to prove the change in marital status and does not have any enforceable force. In contrast, the divorce mediation document, as an official judicial document, not only confirms the fact of divorce but also ensures that all contents of the agreement, such as child custody, property division, and debt assumption, are legally protected. If one party fails to pay alimony, cooperate with property transfer, or fulfill compensation obligations after the fact, the other party can directly apply to the court for enforcement based on the mediation document without needing to file a separate lawsuit.
  There is also a common misconception in life. Some people mistakenly believe that after obtaining the divorce mediation document, they still need to go to the civil affairs department to exchange for a divorce certificate. This idea is actually incorrect. Administrative divorce and judicial divorce belong to two independent procedures, and there is no need to exchange certificates. When handling matters such as remarriage registration, household registration transfer, real estate transactions, and financial loans, presenting the effective divorce mediation document and the corresponding effective proof can be used as valid materials, and relevant units should recognize them in accordance with the law.
  The divorce certificate and the effective divorce mediation document are merely legal certificates corresponding to different methods of divorce. Compared to the divorce certificate, the divorce mediation document also carries judicial enforcement power, which can more effectively ensure the implementation of the parties' agreements. Clarifying this legal knowledge can dispel concerns and facilitate the smooth handling of various subsequent matters.
