  Many families encounter the legal concepts of substituted succession and testamentary succession when dealing with the division of inheritance. Ordinary people are prone to confuse the two, not being able to distinguish their specific application scenarios. Although the two types of succession appear similar, they have clear boundaries in terms of legal definition, applicable conditions, and scope of succession. By understanding the core differences, one can avoid common misconceptions in the distribution of inheritance.
  The most crucial criterion for distinguishing between the two is the order of death of the deceased. Substituted succession applies to the children or siblings of the deceased who predecease the deceased, and is succeeded by their lineal descendants or nephews and nieces, who inherit the share of the heritage that would have been allocated to the deceased. In simple terms, if a child predeceases a parent, upon the parent's death, the heritage is inherited by the grandchild across generations.
  Testamentary succession, on the other hand, occurs when the successor dies after the deceased. If the successor dies after the deceased but before the division of the heritage is completed, the share originally intended for the successor will be inherited by the successor's legal heirs. In short, if the inheritance distribution procedures have not been completed and the successor dies prematurely, the share due to them will be inherited by family members.

  There are also differences in the scope of the subjects of succession. Substituted succession has strict identity limitations, with the lineal descendants inheriting if a child predeceases, and the children of the siblings, or nephews and nieces, inheriting if the siblings predecease. The scope of testamentary succession is broader, with the spouse, children, and parents of the successor, all legal heirs, having the right to participate in the division of the corresponding share of heritage.
  Many people in life have misconceptions, believing that any cross-generational inheritance is substituted succession. In fact, the determination is quite simple: if a child predeceases the parents, it is substituted succession; if the parents die first and the child dies before the division of the heritage, it is testamentary succession.
  In summary, the two rules of succession have clear boundaries and do not overlap in their application scenarios. Accurately distinguishing between substituted succession and testamentary succession, clarifying the boundaries of legal application, can not only legally and reasonably distribute the heritage, protect the legitimate rights and interests of each heir, but also effectively avoid unnecessary inheritance disputes among relatives, maintaining family harmony.
