Some elderly individuals enter into a legacy-support agreement with a caregiver in their later years, whereby the caregiver assumes the obligations of providing care during the elder's lifetime and arranging for their funeral upon death, and in return, the elder bequeaths their estate to the caregiver. At the same time, the elder may have previously executed a will designating their property to children or other persons. When the provisions of a legacy-support agreement conflict with those of a will, determining which takes precedence often gives rise to inheritance disputes.

Pursuant to Article 1123 of the Civil Code, upon the commencement of succession, the estate shall be handled according to statutory inheritance; if there is a will, it shall be handled according to testamentary inheritance or legacy; if there is a legacy-support agreement, it shall be handled according to that agreement. The validity of a legacy-support agreement takes precedence over both a will and statutory inheritance; this is the fundamental principle for resolving such conflicts.
A legacy-support agreement is a bilateral legal act concluded between the supporter and the testator (the person to be supported), whereby the supporter undertakes the obligation to provide for the support, care, and funeral arrangements of the person to be supported during their lifetime and after death, while the person to be supported bequeaths their estate to the supporter. Once the agreement becomes effective, both parties must fulfill their respective obligations, and the person to be supported shall no longer dispose of the property designated for legacy by will.
When a legacy-support agreement and a will contain conflicting provisions regarding the same property, the legacy-support agreement shall prevail with respect to that property; other provisions in the will that do not conflict with the agreement may remain valid. If the supporter fails to fulfill their support obligations, the supported person may terminate the agreement, whereupon the legacy-support agreement shall become ineffective.
In practice, determining the validity of a legacy-support agreement requires examining its legality, the genuine intentions of both parties, and the extent of its performance. The agreement should be concluded in writing, clearly specifying the scope of support obligations and the assets to be bequeathed. It is advisable to have it notarized or witnessed by a village committee or a judicial office to enhance its evidentiary weight. The extent to which the supporter fulfills their obligations directly affects whether the agreement can produce the effect of a legacy.
It should be noted that a legacy-support agreement takes precedence over a will; however, it must not deprive heirs who lack the ability to work and have no source of livelihood of their necessary share of the estate. When concluding such an agreement, the elderly person should carefully consider the interests of all parties involved to avoid intense conflicts with children or statutory heirs.
It should also be noted that during the performance of a legacy-support agreement, if the supporter abuses or abandons the supported person, or fails to fulfill their support obligations as agreed, the supported person may legally terminate the agreement to prevent harm to their rights and interests. Both parties to the agreement shall perform their obligations in good faith to ensure the stability and validity of the legacy-support relationship.
It should also be noted that the scope of property bequeathed in a legacy-support agreement must be clearly defined to avoid disputes arising from overlap with property covered by a will or statutory inheritance. Both parties to the agreement should accurately stipulate the content of support obligations and the scope of property involved; where necessary, the agreement should be witnessed by a qualified professional to ensure its clarity and ease of performance.
In summary, the validity of a legacy-support agreement takes precedence over wills and statutory inheritance; in cases of conflicting provisions regarding the same property, the agreement shall prevail. When entering into a legacy-support agreement, parties should ensure it is executed in proper written form, contains clear terms, and that obligations are fulfilled.
