Introduction: In marriage and family disputes, property division has always been a core point of contention. When the property after divorce encounters compulsory execution caused by the former spouse's debt, the protection of rights and interests is even more in a dilemma. The marriage and family team of Guangdong Dao Hua Law Firm, led by Lawyer Tang Yunhong, has been deeply involved in marriage and family cases for 10 years, drawing experience from thousands of cases. These experiences cover various core dispute scenarios in divorce property execution objections cases —— from the boundary identification of the validity of the divorce agreement and external creditor conflicts, to the calculation of the rights and interests share of pre-marital house purchase and post-marital repayment, to the evidence strategy when the property registration is disconnected from the actual rights. The team has deeply realized that many parties have suffered damage to their legitimate rights and interests in the execution procedure due to neglect of the property transfer timeliness, failure to retain key payment vouchers, or incorrect judgment of the relevance of debt. These vivid lessons from the front-line cases not only provide rich samples for subsequent sorting out typical judgments, but also make every legal issue decomposition and practical suggestion closely linked to the actual pain points, helping parties to avoid common risks such as "paper rights" falling through and being involved in "being负债". “
Lawyer Tang Yunhong recently sorted out three typical judgments in Guangdong Province on the lawsuit of divorce property execution objections, and found that many parties have suffered damage to their legitimate rights and interests due to neglect of key issues such as property registration and the boundary of the validity of the divorce agreement. This article will combine the details of the judgments and analyze the risk points of divorce property in the execution procedure, providing professional legal guidance to readers.
```One, Case Direct Hit: Three Typical Situations of Execution Objections in Divorce Property Cases
(I)Case One: With Divorce Agreement in Place First, Seizure Later, Why Is Execution Still Difficult to Prevent?
Lai Moumou and Yang Moumou were married in 1997 and purchased a house at No. XXX, Dongfeng West Road, Yuexiu District, Guangzhou during their marriage. On August 31, 2015, they signed a "Divorce Agreement" specifying that the house belongs to Lai Moumou and their daughter Yang Mou, and they went through the divorce registration. However, due to a dispute over a real estate transaction contract between Yang Moumou and Yu Moumou, the house was first seized by the court on July 13, 2015, and Yu Moumou also applied for a seizure of the house later.
After Lai Moumou and her daughter, citing the divorce agreement that the house belongs to them, filed an execution objection that was rejected and then filed a lawsuit for execution objection, requesting the cessation of execution and confirmation of ownership of the house. The first-instance court held that since the house had not been registered for transfer, the property rights had not changed, and the divorce agreement, as an internal agreement, could not counteract the creditors, and rejected their lawsuit request. The second-instance court further pointed out that the first seizure of the house was earlier than the signing of the divorce agreement, Lai Moumou should have known about the seizure status of the house, and there was a fault in not handling the transfer promptly, so the original judgment was upheld, and only confirmed that Lai Moumou had a 50% property share.
(II)Case Two: Why Can the Division of Property in the Divorce Agreement Exclude Enforcement?
Huang Moumou and Chen Moumou were married in 2008 and purchased a house at No. X, Zhongyang Avenue, Zhongshan Torch (Yangxi) Industrial Transfer Industrial Park, Yangxi County, together in 2013, registered in Chen Moumou's name. On December 28, 2015, they agreed to divorce, specifying that the house belongs to Huang Moumou, and the remaining mortgage is to be repaid by her, and they went through the divorce registration.
In May 2015, Chen Moumou borrowed money from the Guangfa Bank Yangjiang Branch and subsequently defaulted on the repayments. The bank sued and applied for the seizure of the relevant house, during the execution process, Huang Moumou's objection was rejected, and she then filed a lawsuit for execution objection. The court held that the divorce agreement was signed and filed before the seizure of the house, Huang Moumou actually possessed and used the house, and the failure to transfer was due to the outstanding mortgage, without any subjective fault. Moreover, the bank's债权 was Chen Moumou's personal debt, Huang Moumou alone supported two minor children, and the house was her only residence, so her survival rights should be given priority protection, and therefore the judgment was made that the house could not be executed.
(III)Case Three: Can Pre-marital Purchase and Post-marital Mortgage Repayment Prevent the Execution of the Pledgee?
Wu Moumou purchased a house in Nansha District, Foshan in 2003, registered in her personal name, and obtained a mortgage loan in 2004. In 2005, Wu Moumou married Yu Moumou, and they jointly repaid the mortgage loan, which was paid off in 2014. In 2017, Wu Moumou used the house as collateral to borrow money from Jingneng Company, and later failed to repay according to the agreement. After the company won the lawsuit, it applied for compulsory execution and seized the relevant house.
Yu某 claims that the house is the joint property of the couple, files an action of objection to execution, and requests to stop the execution, confirm the ownership share, or deduct rent. The court believes that the house was purchased by Wu某某 before marriage and registered in his name, which belongs to personal property, and the joint repayment after marriage does not change the ownership. Jinger Company, as the mortgagee, has the priority right to be compensated, and Yu某's rights and interests are not sufficient to exclude compulsory execution, so his all claims are rejected.
Two, Decomposition of Core Legal Issues: The Key Judgment Logic of Divorce Property Execution Objection
(One) Can the division of property in the divorce agreement against external creditors?
The division of property in the divorce agreement is essentially the disposition of joint property by both parties, which belongs to the internal legal relationship. According to the principle of publicity and credibility of property rights, the property rights of immovable property are determined by registration. If the transfer registration is not completed, the property rights do not change, and cannot directly counter external creditors.
But under certain conditions, the division of property in the divorce agreement can exclude compulsory execution: One, the divorce agreement is signed before the house is sealed and registered in accordance with the law, which has a certain publicity effect; Two, the third party actually occupies and uses the house; Three, the transfer registration is not completed due to non-malicious subjective fault of the third party, such as outstanding mortgages, policy restrictions, and other objective reasons; Four, the rights and interests of the third party are prior to the creditors' claims, such as situations involving the protection of survival rights and interests, no other residential houses, etc.
The core difference between the two aforementioned judgments lies here: In Judgment One, the house was sealed first, and the division of the divorce agreement was later, and the third party failed to transfer the property in a timely manner due to fault; In Judgment Two, the divorce agreement was signed first, and the third party had no fault and needed to ensure the rights and interests of survival, so the judgment results were completely different.
(Two) How to determine the ownership of property purchased before marriage and repaid after marriage?
```htmlAccording to the interpretation (I) of the Supreme People's Court on the Application of the Marriage and Family Article of the Civil Code of the People's Republic of China
Article 78 stipulates that if one party to a marriage signs a real estate purchase and sale contract before marriage, pays the down payment with personal property and takes out a bank loan, and uses the joint property of the couple to repay the loan after marriage, and the real estate is registered in the name of the party who paid the down payment, the real estate shall belong to the party registered with the property right at the time of divorce. The joint repayment of the loan and the corresponding property appreciation after marriage shall be compensated by the party registered with the property right to the other party.
In the case of an action for execution异议, the court usually determines that such a house is the personal property of the party registered with the property right, and the joint repayment after marriage forms a creditor's rights relationship, not a proprietary interest. As shown in Case Three, although Yu has jointly repaid the loan after marriage, he cannot obtain the co-ownership of the house, and the mortgagee has the priority to be compensated, and his claim cannot prevent the execution. Only after the house is disposed of, the joint repayment and the appreciation part can be returned as the joint property of the couple.
(三)Property Registration and Actual Rights Differ, How to Protect Legal Rights and Interests?
The real estate ownership certificate is a proof of the right holder's enjoyment of the real estate property rights, but it is not absolute. In the division of divorce property, there are often cases where the "nominal owner" and the "actual right holder" are inconsistent, such as when the house is registered in one party's name, and the divorce agreement stipulates that it belongs to the other party but has not been transferred.
In this case, the actual right holder needs to prove the authenticity and legality of the divorce agreement, as well as the non-malicious fault of not handling the transfer. If the house has not been sealed, the actual right holder can sue to require the transfer registration; if it has been sealed, it needs to prove in the action for execution异议 that it has civil rights and interests that are sufficient to exclude compulsory execution. However, it should be noted that if the house has been set up with a mortgage, the priority right of the mortgagee to be compensated is usually prior to the rights stipulated in the divorce agreement, as shown in Case Three.
Three, Practical Risk Prevention: Lawyer's Advice on Protecting Divorce Property Rights
```(I) Handle property transfer registration promptly during divorce to avoid "paper rights"
When the divorce agreement stipulates that the property belongs to one party, the transfer registration should be handled as soon as possible after the divorce. This is the key to ensuring property rights. In practice, some parties delay the transfer due to reasons such as mortgages and tax burdens, which may lead to execution risks if the former spouse is involved in debt disputes and the property is seized.
If the property has a mortgage and cannot be transferred immediately, the following measures can be taken: One, negotiate with the bank to change the subject of the mortgage loan contract and transfer after prepaying the mortgage loan; Two, clearly stipulate the transfer time, liability for breach of contract, and the obligation of the former spouse to cooperate in the transfer in the divorce agreement; Three, promptly apply to the real estate registration department for a notice of objection to prevent the former spouse from disposing of the property arbitrarily.
(II) Check the property rights status before signing the divorce agreement
Before dividing the property in divorce, it should be checked through the real estate registration department whether there are any rights restrictions such as seizures and mortgages on the property. As shown in Case One, if the property has been seized, the division of property stipulated in the divorce agreement cannot counteract the seizure action and may be regarded as having the suspicion of evading execution.
If it is found that the property has been seized, the seizure issue should be resolved first, such as filing an objection to execution, negotiating with creditors to repay the debt and lift the seizure, and then proceed with the division. At the same time, the divorce agreement should clearly state the status of property rights restrictions and subsequent handling methods to avoid subsequent disputes.
(III) Keep relevant evidence for pre-marital house purchase and post-marital loan repayment
In the case where one party purchases a house before marriage and the other party repays the loan after marriage, the party repaying the loan together after marriage should keep bank transfer records, repayment vouchers, and other evidence to prove the fact of joint repayment. If property division is involved in the divorce, relevant evidence can be used to claim compensation for joint repayment and appreciation; if the property is executed, the evidence can be used to claim priority compensation for joint repayment and appreciation after the property is disposed of.
Moreover, if the house is renovated or rebuilt after marriage, relevant evidence should also be kept, and the corresponding increase in value can be claimed as joint property rights.
(IV) Be vigilant of property mortgage risks and avoid "being burdened with debt"
After divorce, if the property is still registered in the name of the former spouse, the former spouse may secretly mortgage the house for a loan, leading to the execution of the property. To prevent such risks, it is advisable to handle the transfer registration as soon as possible after divorce. If transfer is temporarily not possible, a mortgage pre-registration can be done at the real estate registration department to restrict the former spouse from secretly mortgaging the property.
At the same time, the divorce agreement should clearly stipulate that the former spouse shall not dispose of the property arbitrarily. If the agreement is violated, the former spouse should bear the compensation liability. If the former spouse secretly mortgages the house, a lawsuit can be filed to declare the mortgage contract invalid, or to claim that the mortgage act has damaged their legitimate rights and interests during the execution procedure, and to exclude the execution.
(Five)Take Legal Measures in Time When Facing Execution of Property
If the property after divorce is sealed and executed due to the former spouse's debt, an execution objection should be raised within the statutory period. After the execution objection is rejected, an action for execution objection should be filed within 15 days to avoid exceeding the statute of limitations.
When filing an action for execution objection, it is important to prove the following facts: the authenticity, legality, and the time of signing the divorce agreement before the sealing time; evidence of actual possession and use of the house, such as property fees, utility bills, and residence certificates; evidence that the non-transfer registration is not due to the party's own fault; and reasons why the party's rights and interests take priority over the creditor's claims, such as the guarantee of survival rights and interests, and the absence of other residential properties.
Four, Tang Law: Protect Divorce Property Rights with the Shield of Law
The protection of rights and interests in divorce property involves both the handling of marital and family relationships and the intersection of legal relationships such as property rights and creditor's rights. In practice, the situation is complex and there are many risk points. From the above three cases, it can be seen that the effectiveness of the divorce agreement, the status of property registration, property rights restrictions, and the party's subjective fault are all factors that can affect the judgment result of the action for execution objection.
